I m running my own proprietorship business. I m planning to get married in Nov 11 with a person who is presently associated with my business and I am paying him remuneration.
I trust him but want ot know how can I protect my earnings as on date as well as future earning of business.
What if we have fight and have to seperate, can he claim from that property.
If we sign on mutual agreement stating that he has no right in my property / earning, is it valid as per HM ACT?

It appears you are lady and person engaged with you for marriage is your employee too. You need not worry about ownership of your business assets as a marriage creates rights confined to joint living and joint sharing of bed alone and does not confer any right in the property of the spouse. Do not anticipate fights even before marriage rather take a decision after due consideration given to matter of matrimony ,after all it is not decision imposed on you but taken mutually . A pre-nup is an agreement made between a couple that's about to get married that outlines the fate of finances and personal liabilities in case the marriage fails
prenuptial agreements are not valid in india as marriage is sacrement and not a contract .

If you run the business in your proprietary capacity then the spouse by dint of marriage only does not become its co-owner or co-sharer. So do not worry as long as he is not made a share holder in the said business.
