dear sir,
my sister had married with one of the person setteled in US as the marriage has taken place in nashik and the same is registered in registrar office after she went to U.S at the husband place on dependable Visa. due to some clasess they had started harrasing her and she got back to india 3 yrs back after i sent money for ticket,we have not taken any legal action against them and never contacted them recently i came to know that the said boy was got married with some one else.
i want to know
1) is it possible that without getting divorce from indian court
2) what are the possible ways to get the divorced form him
3) is any provision is there to take action against him by approching U.S ammbessy

1. It is illegal to marry again without getting divorce. From the facts it is seen that only indian court has jurisdiction.

2.Collect the proof of his 2nd marraige. You can take action file filing a complaint against him under sec.494 of IPC and other relevant laws.

3. You can file a petition for divorce here in india.

the main question is whether the parties were being governed by the Indian Laws.

that person might have applied for divorce in US....pls find out the details.

sir, thanks for attending my query will you suggest me on the following points
1) if the marriage is registered can the divorce will take place in mutual consent.
2) as the party nither contacted us in oral or written nor by legal notice and we do not know the communication address of them in US can we send the notice through ammbessy.

Yes your in law governed by indian laws.. Cos he married with an indian girls as per indian law.. Also marriage got registered.. So with a clear evidence you can approach our court of law.. But the burden of proof is your's..
