Respected Sir / Madam, A victim found after 13 years of a registered gift deed and a registered sale deed performed, were done with some false statement of relationships. The victim did not know of the registered deeds for last 13 years. After knowing the fact the victim collected the copies of the registered deeds online. After that the false statements of relationships are found. Can now those registered deeds be challenged in court to cancel ? If possible, please let me know the process. Thanking you. Jayanta.

Who is that victim and how are you concerned? If you have sufficient grounds regarding the sale deed and gift deed, he can file a suit for cancellation of the deeds. Consult a local lawyer.

A suit for cancellation of registered documents (sale deed & gift deed) can be filed within three years from the date of knowledge on ground of fraud, cheating & coercion.

The so called victim, if aggrieved by the reported acts of fraudulent sale deed and since it has come the victim's knowledge only recently i.e., within three years from this date, the so called victim can approach any advocate in the local with the property documents and file a suit for cancellation of the fraudulent sale deed and seek possession if not in possession and have any rights and interest in the property
