Dhoka Dayak Imarat -MEANS- Dilapidated Building (dangerous for human habitation)
1. In Mumbai area, ONLY the BMC is the authority to declare the building as unsafe for human habitation, AFTER due investigation and scrutiny u/s 353-B r/w 354, of the MMC Act.
2. IF BMC has declared the building as Dilapidated Building (dangerous for human habitation), THEN the BMC shall suo motto demolish the building for the larger interest of the Public, u/s 348, by following due procedure of law. Privately owned non-cessed dangerous and dilapidated buildings can also be demolished under the National Disaster Management Act of 2005.
