Widows right to property of inlaws

(Querist) 10 March 2015 This query is : Resolved
hi,i have a two year old son and my husband passed away last year. he has not left behind and financial security for both of us. there is no clarity if deceased father inlaw left anything in his name. I am working but the salary is not enough to cater everyday needs. I am living with my parent my father is retired and there is no financial support from my mother inlaw or brother inlaw. Can I legally ask for right to property for my son..
Kumar Doab (Expert) 10 March 2015
The share of the married deceased son (deceased husband) devolves upon his ClassI legal heir i.e. spouse/children.......except in case of self acquired estate of the inlaws in their life time.

You may involve the elders and try to resolve amicably and also to know the terminal benefits of deceased (if he was employed) and/or share in ancestral property,business,bank/post office accounts/shares/mutual funds/life insurance/medical insurance/PPF etc.

Your lawyer after due examination of
records, inputs may opine that you can ask for maintenance......

if it is your in laws self acquired property you cannot claim any share in their property . thy are free to bequeath property to whom soever they so desire

Agree with the expert ajay sethi.

Without knowing the type or nature or property it will not be possible to give a proper opinion.
