Division of portion

Hello Sir,
My dad owns a property and now wants to give it as a gift to both of us, me and my elder brother. Is there a law or rule saying that front portion will be given to so and so or is it Dad's wish?

It is your father's wish and prerogative to gift how much and what portion and to what person he likes.

The donor can dictate the terms of gift to be made in accordance or as per his wish and desire, the beneficiaries, being in the receiving end, cannot raise any objection to the distribution made by the donor as per his choice.
