Gift deed

hi,
The gift deed was made in 1981 in mumbai and now the donor and donee are dead. So can the son of donee register the will and claim rights to the property.

Please be clear. Whether it is 'Gift Deed' or 'Will'. Both are different and not the same.

it is not mentioned as gift deed but mentioned as affidavit cum indemnity bond... but it is mentioned in the clause which specifies clearly that we(donor) give or surrender to them (donee)xx amount of land for their exclusive use and enjoyment and we relinquish all our rights, title and interest in respect of the said land.

If it is gift deed it should have been registered.

my question was can the deceased donee's son register it now as the donee is dead.

after 33 years gift deed cannot be registered. an affidavit cum indemnity bond does not require registration

Gift deed can not be registered if donor has expired.
