Case against big auto company in consumer courts

Hi All,

I have been fighting a case against a big Auto company for supplying me a defective vehicle.Many attempts by service center could not resolve it and all visits are recorded. Distt comm court had given order in our favour and allowed us small compensation along with change of vehicle with litigation expense due to 2 reports by experts in our favour.
Company appealed against order and State Comm court also favoured us on same lines but removed compensation.

Now company may move to National Comm.
My Query is:
1) How much strong is our case and What are the different outcomes we can expect.
2) How we can get compensation that too more than earlier allowed by distt court as we did not go into appeal in State Comm.
3)What should be our strategy to win the case.

you can expect that you will get new vehicle plus litigation expenses .

compensation depends upon discretion of commission .

You may get the expenses related to the suit. along with new vechicle as per the order.

Hi,
Thanks all. But would like to reiterate my query that although we have won twice, is there any chances by which we can loose in National comm or Supreme court.
Also litigation expense allowed are only 25K, whereas expenses for State comm and Further like National comm may go upto 1.5 lac, how we can include that in compensation.

None can anticipate about your victory or losing the final battle. No person of prudent ind can even ask such question.

There is no rationale or proportionate method to calculate the litigation expenses and compensate it. Whatever has been granted by the Court, is final amount and no further agitation can be made thereto.
