Divorce

Hi Sir,

Without the Permission or consent of the wife can husbad can give divorce he can file a petition on her.

I mean i dont want to stay with my wife i wanted to give her divorce if she will not accept my divorce i will get it or not. Can i fight for divorce as she likes me but i wont like her.

Either of the spouse can file a suit for divorce even if the other is not ready for divorce.

However mere disliking is not aground for divorce.
You have to make out case of divorce like mental cruelty etc. Read section 13 of Hindu Marriage Act to get idea of grounds of divorce.
And do not take all important decision on marriage with sch haste.

REPEATED QUERY..
YOU MARRIED LAST YEARS AND NOT ELIGIBLE FOR FILING DIVORCE AT PRESENT.

It is tendency of almost all newly married , that WIFE want to get you separated[residence] from your parents. It is nothing new.

So WAIT & WATCH.

for filing divorce you must have some ground as it is stated in sec.13 of hma , mere liking and disliking your case will not maintainable in the court , it is easy to file divorce but be careful it is not so easy to get it , if your marriage has not completed one year then still you cannot file divorce you have to wait for the one year completion of your marriage , either of the spouse can file the divorce if both are ready for divorce then opt mcd and if not then go for contested divorce.
