Respected Seniors!
in a complaint under section 506 IPC, the complainant have not mentioned the time and date of occurance of the offence and the Accused have filed quash. now is there any possibility to fight the said Quash? and is there any citation or ruling by Hon'ble S.C. as its not mandatory for mentioning of time and date in the said offence?

We do not provide the judgments but the petition seeking quashing of complaint can definitely be contested on the grounds mentioned in the complaint itself. Particulars of the offence are basic ingredient of a criminal trial and absence of such material is fatal to the case.
