Chargesheet

(Querist) 25 February 2014 This query is : Resolved
SOMEONE HAS FILIED COMPLAINT AGAINST ME UNDER 323 AND 504 OF IPC.
NOW TILL TODAY THERE IS NO ANY COMMUNICATION FROM COURT OR POLICE STATION .

NOW MY QUESTION IS THAT IN HOW MANY DAYS THAT POLICE CAN FILE CHARGESHEET AGAINST ME ?

Devajyoti Barman (Expert) 26 February 2014
There is time limit for submission of charge sheet.
However you may engage an advocate to take information from court whether the police has indeed submitted it or not.
Nadeem Qureshi (Expert) 26 February 2014
Dear Querist
both the sections are non cognizable offence, the case will be registered as NCR.
to know status contact a lawyer, it will be better
Guest (Expert) 26 February 2014
Well advised.
Biswanath Roy (Expert) 26 February 2014
Sec.323 IPC and Sec.504 IPC both are non cognizable, bailable and compoundable cases. Both of these sections are summon cases and not warrant cases, and because of this no charge is required to be framed.
Rajendra K Goyal (Expert) 26 February 2014
Well advised by the experts. agree to it.
DEEPAK DHAMEJA (Querist) 26 February 2014

what is time limit of submiision chargesheet
Satya Mani Tiwari (Expert) 26 February 2014
I agree with the advice of the expert Mr. Biswanath Roy as both sections are Non- Cognizable in nature hence police wil not file charge sheet in your case summon will be issued by the court itself in which complain has been filed its better for you to hire an Advocate to file application in the said court to get the copy of complain in order to file reply accordingly.
T. Kalaiselvan, Advocate (Expert) 28 February 2014
Yes I agree with the experts advise, you may proceed with the case by engaging a local lawyer.
