Sec 9 of city tenants act

Respected senior's
The charitable trust has filed a suit against the 5th superstructure holder/tenant. I am the 5th owner purchased the superstructure and till date iam paying rent to the trust. Now the stage has come to trial. At this stage, when i filed Sec 9 (to purchase the land of the trust)my application was rejected stating time limit is 30days after receiving suit summons. Whether my application can be entertained and how? after purchasing this property iam here for morthan 20 years. Kindly suggest me how i can protect the property without giving to the charitable trust?
