Dv case fees by lawyer

(Querist) 26 May 2013 This query is : Resolved
Hi experts

my wife put 498a and Dv case in her home town
and there we took a lawyer in hurry burry as we have to take bail and all that. Now in DV case my lawyers is asking rs 5000 each means total number of accused multiplied by 5000 for some stamp duty and legal formalities is it correct or he is making just fool of us.
Raj Kumar Makkad (Expert) 26 May 2013
He is making you all fool. No stamp is required to be affixed except on vakalatnama which may be of Rs. 10 or below Rs. 25/-. Typing cost may be around Rs. 200/-. No more expenses are required to be made and this expense is for all respondents if the joint written statement is to be filed. Change your lawyer and also make complaint against him before Bar Council of his State.
Adv Archana Deshmukh (Expert) 26 May 2013
Perhaps you might have misunderstood, he might have quoted his fees to defend per accused. However, if he is asking the said amount towards stamp duty then, as sh. makkad said he is making you all fool.

Actually i am scared beacuse still 498a charge sheet is not filed and we all r assuming that B4 chargesheet of 498a we should keep quiet already 4 months is over.

can my current lawyer dilute the case if we removed him.

pls suggest

There is no danger of any dilution. Change of lawyer need nothing special. Engage another lawyer and he shall get NOC from previous one.
