Section 307 applied or not

(Querist) 13 April 2013 This query is : Resolved 
doctor first medical report state that injured person got serious head and leg injury but then doctor give second report state that injured person not been treated for any type of head injury he operated for his two legs injury
in this case section 307 applied or not ? police file fir u/s 307. and produce the first medical report of doctor in court

You have not mentioned whether the doctor in both reports was same?

This is very strange case. If there was only a leg injury not a danger for life then the imposition of section 307 is illegal. This is the fittest case wherein the doctor submitting his earlier report should be got removed from his post by filing a detailed complaint against him not only before his departmental bosses but also before High Court so that other doctors may also take lesson and may not issue false reports under the 'heavy weight' of coins.

Then you produce second medical certificate. That would be sufficient enough to create a cloud of doubt about the whole incident.
