Respected Forum,
I have to face 498A,406 in UP after we failed to continue after 7 month mediation & settle out of court. My Delhi lawyer suggested to file divorce while UP lawyer is taking dates and advised to wait for some more time and and we haven't appeared in UP court till the time.Can it go against us.
Request your guidance..

If you are already on bail and remained absent to appear before the court NBW will be issued against you. If you have got summons to appear in the criminal case nothing will happen.

How have you settled the cases when all the cases are pending?
Settlement means withdrawal of cases and mutual divorce unless both parties reconcile.

We were cheated by them and they didn't take case back.This is the current situation.
But my question is, if my lawyer is arranging dates from court and also, we have not received any summon then in this case too, warrant can be issued?? Five times dates have been issued already.

yes court can issue warrant if you dont appear . better attend court .
file for divorce . your wife has already done her worst . she has dragged you and your family into 498A web .
