In our case three main issues was framed
(1)whether this property is self acquired or ancestral.
(2)whether will is doing on certain date.so prove the execution otherwise the share of the parties.third one is relief.
for this first (issue) we submit the original sale deed of the property and indiviual income tax returns.second party also putup several questions from the defendant on this matter.second the advocates of the plantiff also admit he(my dadaji) is earning in his own capacity.
for the second issue one witness of the will who is also a scribe of the will also admit his signature and execution of the will.HIs witness is complete.second witness also admit his signature on the will and verify his signature on probate petition and his witness is going on.
My query is :
(1)can we prove the first and second issue.
(2)can first witness is sufficient to prove the unregistered will who is also an scribe?

botht he issues are proved . you have examined attesting witness who have seen the testator sign in their presence and who have signed as witnesses . further you have proved that it is self acquired property by producing original sale deed which mentions the consideration paid for the property and the income tax returns showing money paid for purchase of property by the testator
