Certified order

Respected Sirs,

Its almost been 14 days JMFC Judge has passed the interim order but till know he haven't dictated any order. I am worried coz I need to appeal in session court. Does certified copy of orders has date.

How can I get certified copy asap

I have only thirty days to appeal.

period of 30 days would be counted from date of receipt of certified copy of order .

Limitation to Appeal start from the date of signing the Order.

After order, the days to give you certified copy , after your Application is not counted, in calculating period of Limitation.

So do not worry about it. If already dictated, manage to copy down word to word, and keep your Draft of Appeal ready.

You Apply for TC, they will provide if Ordered, or delay it, and those days of delay are automatically condoned.

You have to apply immediately for certified copy of order.

The appeal needds to be filed within 30 days. But, the days lapsed between application made for appeal and receipt of the copy by applicant will not be considered.

Does it means when I will get certified copy from court, the date will be mention stating when it was certified.

In a certified copy, the following dates will be mentioned.

1. Date of order
2. Date of application received for certified copy.
3. Date on which the certified copy is ready.
4. Date on which the certified copy is issued to the applicant.

Thus, if you have applied immediately on the smae day of passing order, then you need not worry.

If not yet filed, then the days counting from the date of order and the date of application for certified copy will not be considered.

Yes the 30 days is counted excluding the time taken for point no. 2 to 3 as stated by Mr Nair.
If the copy becomes ready but you did not receive the same you would not get the relaxation in time.
