Essential comodities act

Querist : Anonymous (Querist) 03 September 2011 This query is : Resolved 
order of confiscation of kerocene is passed by collector under sec. 6-A of the essential comodities act. Appeal is provided under section 6-C. my question is that before whom appeal have to be filed. either before commissioner or before session judge ? the matter is of madhya pradesh state. however no state amendment is made in central act.

Appeal is to be preferred before Commissioner and not before Sessions Judge, as wrongly opined by some experts.

Which Commissioner?

I don't know this that if the order of Collector is there then Commissioner is the higher authority.

As far as my knowledge and system prevails in Gujarat The Collector is .........."The District Judge" and on the ground I had challanged the Commissioner (Municiple) for disobeying the ORDER of Collector in one Land Allotment Case,and he had to rectify his decision.



So I feel the higher authority is Sessions Court then the Collector.


I may be wrong in case of M.P..
