Refusing / Denial to have sex is a ground for divorce. But, it can not be treated as cruelty.

1. Denial of sex is not exprssly mentioned as a ground for divorce in S. 13 of HM Act. 2. Courts have held that willful withholding of sex by a spouse would amount to cruelty. 3. Sexual "satisfaction" is a vague term and cannot as such be a ground.

Sexual satisfaction is a relative term. The degree of satisfaction varies from person to person. sexual dissatisfaction is no ground for divorce.

sexual dis-satifaction is not a ground for divorce case! Courts have held that willful withholding of sex by a spouse would amount to cruelty whereas sexual intercourse without wife's consent leads to Rape
