Advocate. Arunagiri (Expert) 09 June 2011
Refusing / Denial to have sex is a ground for divorce. But, it can not be treated as cruelty.
Dr V. Nageswara Rao (Expert) 09 June 2011
1. Denial of sex is not exprssly mentioned as a ground for divorce in S. 13 of HM Act.
2. Courts have held that willful withholding of sex by a spouse would amount to cruelty.
3. Sexual "satisfaction" is a vague term and cannot as such be a ground.
Sarvesh Kumar Sharma Advocate (Expert) 09 June 2011
