property share by grandsons

Querist : Anonymous (Querist) 23 December 2010 This query is : Resolved
daughter in law divorced son.

Son married another woman.

Does children (Currently minors) of first wifes have any property rights on grandfather. say on residential property?
R.Ramachandran (Expert) 23 December 2010
If the property in question is ancestral in the hands of the grandfather, then the children by the first wife do have a stake in the same.
If the property is a self-acquired property of the grand father, then they do not have any claim.
Pritam Saini, Advocate (Expert) 23 December 2010
I agree with expert.
Y V Vishweshwar Rao (Expert) 23 December 2010
as suggested by Mr Ramachandran - it depends on the nature of property .
Kirti Kar Tripathi (Expert) 23 December 2010
I also agree with Mr. Ramachandran, it will depend on nature of property,
Devajyoti Barman (Expert) 23 December 2010
yes all are right.
s.subramanian (Expert) 24 December 2010
If the grand father is alive, this doubt will arise as to the nature of the property. If he is not alive, then automatically the grand children have rights. Divorce cannot take away their rights over the property.
