Official pursuing studies.....

An employee while working in a Central Govt funded organisation under Min of Science and Technology is pursuing LLB course. His application for permission was denied by the superior authority. However he has enrolled for LLB course and attending classes between 7 am to 10 am and 5 pm to 7 pm. His official working hours are 9:30am to 6:00 pm. So on face of it he is attending classes by reporting late to work and leaving early. However his superior authority feels that this is not misconduct and on the sly allowing him to pursue studies while denying the same facility to others. My complaint on this matter was thrown away saying that his enrollment for LLB course is not within the knowledge of the organisation which is false. What remedies do i have to proceed against such employee under CCS (CCA) Rules 1965

Must condone timings for such noble purpose of Education. It improve Employee efficiency, and thereby benefit Employer too. [free of charge Training, Law study help everywhere.]

In fact hundreds of employees are continuing LLb in the same pattern, and law colleges adjust their timings to suit such employees.Their degree is also valid and accepted.In what way your are aggrieved?.Expert Shroff has magnanimously commented on your query.Be generous,not jealous.

If he is discharging his duties and responsibilities efficiently, minor adjustment in attendance hours should not matter in any case until his studies cause hurdle in discharge of his duties.

Moreover, unless his superior authorities/ disciplinary authority do not take adverse note of his late coming or early going, nothing can be done.

Sirs, first of all I am not jealous since I have no axe to grind. I hold the highest qualifications which none can compare in my area of DNA testing. The problem is that this official's involvement in LLB is affecting the lives of several people whose DNA he is supposed to test. Further the same rule is not being followed for class 3 and class 4 employees who are more interested in furthering their careers by doing correspondence courses. Thats why I want to take up this issue with the management.

No doubt, regular late coming and early going is a part of indiscipline on the part of the official. The question is not of jealousy, but when the superiors and the disciplinary authority prefers to keep their eyes closed, who will tell them to bell the cat. So, instead of pointing out the same, which is considered negative approach, you can better plead for enhancement of the abilities of the other staff by extending the same facility to other staff also, who want to carry on their education further. However, it will be more beneficial, if the concerned staff members, who are desirous of getting permission for admission to higher courses, represent themselves for permission on the analogy of the said member of staff, who has already been getting the facility.

If Officials are playing partiality and ignoring the matter that his enrollment for LLB course is not within the knowledge of the organisation then you first need to collect the evidence to prove that he is doing LLB and then come back here to know how to proceed against him.

Sirs Shri Dhingra and Shri Prabhakar Singh have got my point right. Thanks. I have collected all the information under RTI Act and please guide me now how to proceed. I am in a dilemma whether I should complain to the CVC or the Dept of Administrative Reforms and Public Grievances of Min of Personnel. Please let me know.

Instead of curtailing the opportunity of your colleague to study LLB, in the name of strict rules, try to get such opportunity to you and get legally wise.

I take strong objection to Mr Raju.O.F. statement. Can't a person try to help other colleagues whose opportunities were stamped down when they wanted to study further by a dictatorial Director while allowing his favorites to study. I am not here to help myself. As said earlier, none in this country can match my qualifications in DNA testing and I don't need LLB for my career. Please think thrice before you advice.
