Dear Sir,
My father has expired in 1980, unfortunately we did not apply for legal heirship certificate but we got the death certificate. we have three sisters and myself and my mother.
Due to the fact, can we apply now for the legal heirship certificate after a long silence ? and what is the procedure to apply the same in Tamil Nadu?

Legal Heir Certificate can be applied at any point of time. But the only fact is, the position of all the legal heirs as at the time of death of the person concerned (including those who might not be alive now) has to be mentioned while applying for the certificate. You please approach a local lawyer and he will do the needful for you.

Move an application supported with death certificate of your father and supporting affidavit of you all to the effect that no any person except you all is the legal heir of your deceased father. This application is required to be made to your local Tehsildar and there is no need of any lawyer for this purpose. You personally can do this simplest process.

No,Limitation applicable,Tehsildar is commonly the authority in every state who issues it on report of Lekhpal (record keeper)of area.An application signed by all togather with affidavit and no objection can serve the purpose.
