sir,
my father brought one house in tamilnadu housing board via government loan at a cost of rs 145700. he was expired while in service.so the goverment has cancel the remaining amount,and relase the mortage deed to my mother.to buy sale deed from housing board the housing board ask my mother to pay a sum of rs300000/to release the sale deed.the housing board calculate todays land value of rs300000/what i have to do sir,whether i want to move to the court?to cancel the todays land value.plz give me proper direction via dineshrajaips@gmailcom

The action of Housing Board is totally illegal as your father had already purchased the house which cannot be taken back on his death so go to civil court and seek stay order against proposed action and settle the account as shown due against your father.

The legal hier has the right to step in to the shoes of the deceased on the same terms & conditions, as entered in to with the deceased. The action of the housing board therefore seems to be totally illegal. However, it would be better for you to go through the terms and condition of the allotment with particular reference to the deceased cases before you resort to some legal action.

I agree view of dhingra sir. In addition to that the civil court have no jurisdiction agaisnt TNHB. you would go to High Court, if needed.

My advice is just approach your high court by writ of mandamus. Before that take necessary steps as in person.
