(Querist) 16 April 2015 This query is : Resolved
My father comes to Delhi from UP, 50 yrs ago and now we are resident of Delhi. After so many years later, we found our Great Grandfather had a agricultural land in UP (Fard showing that). But the problem is that we don't have any document which showing relation with our great grandfather. My Great Grandfather had only one son (my grandfather) and who had two son ( my father and my uncle only ) and my father had died in an accident and my uncle still alive. So, please show me/us the way to claim that land to register in our names.

Your father and your uncle are the legal heirs. Since your father died, your mother and you and your other siblings are the legal heirs on one part and your uncle in another part. You can get a legal heir certificate from the competent revenue authorities within whose jurisdiction the properties is situated. However, the legal heir certificate is only for limited purpose and you may file a civil suit for grant of succession certificate. A succession certificate is issued by a civil court to the legal heirs of a deceased person. If a person dies without leaving a will, a succession certificate can be granted by the court. It establishes the authenticity of the heirs and gives them the authority to have securities and other assets transferred in their names as well as inherit debts. It is issued as per the applicable laws of inheritance on an application made by a beneficiary (legal heirs) to a court of competent jurisdiction. After obtaining the succession certificate, you may approach the concerned revenue authorities for change of name of the owner of the property in their records.

Consult local lawyer and file suit for partition of the land. Record can be taken from local patwari.

We are going to the local patwari and he says that the land is on the name of Mr. X and how we can know that Mr. X is your great grandfather, show us some proof/relation to G. Grandfather/ any document which shows you are legal heirs of them. So, what should I do?.

Contact, engage and consult a local lawyer with all relevant documents.

Without proof of your grandfather's identity and establish your relationship, how do you think the experts here can advise you ?, firstly you should consult a local advocate, find out the possibilities on such issues, make personal efforts and after failing in all your efforts, seek clarification if it is really worth enough.
