Remedy for water seepage by other flat owner

I live on topfloor, on which water tank of other owners is on our terrace they with help of police and breaking bolt taken key of terrace. Their water tanks keep leeking and that has damaged celing of my house. Also my water was found damaged one day now when owner was given legal notice he alleges we damaged his water tank. Jal board gave them notice but still not able to prevent seepage and not got us any compensation for damage to property. What all legal action can be taken in such situation? can we approach consumer court also?

Give proper reply to their notice, in turn you too send a notice for your damage and compensation arises to your ceiling and consequences thereto. You take injunction for operating the overhead tanks on your terrace and to shift it from another place from your terrace.

Reply the notice denying all the charges. Send him notice mentioning the leakage and claim damages. Contact local lawyer.

You had to give more details.Are you owner of a flat along with other owners in a multi storied building?Is there an association of owners?

@ Yes, we all are owner of flats. There is a residential welfare association but my neighbours I am taking about are themselves heading this association.
@ The notice is given to them.

Assess the damages with the help of your engineer, file a suit claiming damages.

First try in civil side.
u can file criminal case if u hv proof of someone did it intentionally to harass u.

As I have told in a previous query by another author , the Police are registering cases from flat owners on "Social Service " category and call the parties concerned to police station to get a solution.
Go to nearest police station with your story: that will be more better than prolonged litigation process.
