i have a shop which is given to rent to a doctor for 5 yrs. now he is not in a mood to vacate it. i do not have a rent agreement.how do i vacate it.also in indirect ways he is threatening me of a possible assault or attack by him.what are my supporting laws?

file civil suit for eviction of the said doctor. regarding assault file criminal complaint case or register FIR with the concerned Police Station, ultimately you have to take shelter of Law before the Competent Court of Civil or Criminal wings. thanks.

Eviction petition under Rent Control Act is to be filed before Rent Controller and not before Civil Court. Even if you have no agreement then also you can get eviction on the basis of your self need/requirement. There might be MC assessment, electricity bill, municipal tax, any repair bill, photographs etc. establishing your ownership/landlordship and tenancy of that doctor. A local commission can also be got appointed to see the site and file his report.
