Tenant vacated but did not handover the key ?

Querist : Anonymous (Querist) 10 May 2011 This query is : Resolved
I won an Eviction lawsuit against my tenant.

My tenant vacated the house on the last day granted to him for eviction but did not hand over the key to me.

I do not even know the new address of my tenant.

How to get the possession of this house ?

What are the legal way outs, suggest please?

It is better to go in legal way i.e, filing of execution petition.

you can break open the lock by filing the execution petition with help of court staffs

Mr. Rajoo, thnx for suggesting, but can U tell me that how the execution petition would work, while there is no tenant at that place(he has left the place and the place is locked now),I mean to ask, would it be possible to break the lock and take the re-possession in front of some Process Server of the Court?

Or what would be the process, how it would be materialized?

Please guide, request to all the Respected Experts.

You can say that the tenant had vacated. Only if he hand overs the possession to you, you can treat that he had vacated.

So, file the EP.

File execution petition and get the order from court to pull the lock in the presence of court nazir.
