Filing of additional typed set of documents before the cat

Respected Learned Experts, Wish you one and all Happy Diwali in the Forum. I had filed an OA before the CAT, Chennai Bench for MACP benefits. The department has filed reply to Rejoinder. In this context, I want to file additional typed set of documents before the CAT to substantiate my claim. Please inform me the Rule under which the Additional Typed Set of documents to be filed. Whether, it should be filed as Miscellaneous Petition. As I am appearing as Party In-Person, I pray the Learned Experts to guide me in the matter. Thanks in advance with anticipation.

In my view, the court has the discretion to allow additional documents, but this is not granted automatically and must be requested through a formal application.

Respected Learned Expert Shri Sudhir Kumar Sir, I had already filed rejoinder for which the Respondent department has filed reply to rejoinder. In the reply they had quoted one High Court order in which I was the Respondent. The High Court order relates to regularization of suspension period and my promotion. The High Court has pleased to regularize the suspension period but rejected my entitlement of promotion as I had already retired. Now the Respondent department is referring the said High Court order stating that I am not entitled for any other benefits except the regularization of the suspension period. However, the Respondent department has not filed the copy of the High Court order before the CAT. MACP is not a promotion as per the DOPT guidelines. Hence I want to file the copy of the High Court order before the CAT. Please oblige. Respected Learned Expert Shri

The High Court case is not against the complainant in the sense of a new legal battle, but a challenge to the CAT's final order. Ask the High Court to set aside or modify the CAT's decision. This is typically done by filing a writ petition in the High Court

If the respondent is relying on the HC order they would have annexed the same with the pleading. Even otherwise, with the permission of the Court, the judgment could be produced at the time of hearing.

Please note that the CAT cannot grant the applicant MACP but can only issue direction that applicant be considered for grant of MACP.

To file additional typed documents with the Central Administrative Tribunal (CAT), you must submit a Miscellaneous Application (MA) asking the tribunal for permission to place the documents on record. This is the standard legal procedure for adding new materials after the initial filing of the Original Application (OA).
