I have recieved a notice from the postal customs officer / commisioner regarding a product i have ordered from the USA. The product is tobacco made by dunhill. They have written in the notice that it is a product prohibited for import but on the official mumbai customs website itself they state that a passenger can carry 250 gms free of duty while coming to india. Kindly note, i have ordered it by post and not personally carrying it. Also, when i searched the net , i could not find one place where it is written that import of tobacco for personal use is prohobited or banned. Also, i do not want to sell/ resale it is for personal use and value is only 40 US dollars. Now they are threatening me with penal action under section 112(a) . What should i do. What is my stand . Is it really prohibited. If yes under which act/section ?? Please help .. This is top most urgent .. Thanks in advance !!

Mr. Nikhil,
The postal department has a huge list of banned items to be transmitted through post. Also, there is a marked difference between a passenger carrying such items in person while travelling and getting through post. Better meet the concerned officer and try to compound the offence by paying fine, if possible. Otherwise, no let up.

The P.O. has no power to levy any penalty. It is the cutoms department which fixes any penalty or decides whether to launch a case in the court of law check on landing of the foreign postal articles on the airport. However, if they have not released the article to the P.O. for delivery and have siezed the same, you will have to contact the concerned cutoms officer at the airport for further necessary action.
