Claim rejection by mobile insurance company

I had taken an insurance for my mobile which covers accidental damages as well. Recently I met with an accident in which my mobile got damaged. I was sitting on the back seat and my mobile was kept on the seat as I my bottoms did not have pockets. My claim got rejected on the ground of negligence as u should have kept ur mobile in your hand or some safe place. Can any action be taken against them?

Anyway you may show the insurance policy and its T&C to your counsel.
