Rent

Dear Friends, I m tenant in house. I sent the rent to my land lord for the month of Feb 15 by MO but they refused. I came to understand through people my building has been sold to someone else, hence they refused . by so fat they have not informe about this matter that it has been sold. they knowingly doi8ng this act to get it vacate. pl advise me.

You continue sending the rent to old landlord(till you know from them or otherwise authentically that the building has been sold) through money order and on refusal, send letter that they have refused to accept the rent sent through money order and to collect the rent from your premises in future.

I agree with the expert advise of Sh. Rajendra K Goyal, it is duty of vendee to inform the tenant regarding transfer of title of demised property.
However, if refused, deposit the rent in the Court.

u file a petition before the rent controller for depositting rent and also add the new owner as a respondet, plz contact ur local lawywer

You may follow the steps suggested by expert Mr.Rajendra K Goyal,however under no circumstances you vacate the house without any confirmation.

Sir, I have sent detailed letter to them with fresh check also but she returned with post office remark " refused " . Pl. advise me about next step . it is just pending for the month of Feb.15 only. Earlier she use to come and collect the rent from my house only . shall I sent again 2 month rent my Money order in next month ? I feel she is doing knowingly not to inform and not to collect the rent to get it vacat by the buyer. Pl advise

Sir, Premises has been sold out and intimation has not been sent to me that to whom it has been sold and rent to be paid to new buyer. My advance deposit is also with my old land lord.I came to understand through someone that the property is transfered under will by original land lord and 3 beneficiary are there. but it has been sold by the 2 beneficiary i.e. by mother and daughter as legal heirs without the knowledge of 3rd one, hence it is not inform me,Pl advise accordingly

If you are sure that the owners have changed due to transfer of property, you will have to go cautiously and collect adequate evidence in your favour, as the lessor ceases his right to collect rent after transfer of property. So if the property is really transferred, you would be liable to pay the rent only to the trnsferree of the property (new owners. However, so far as your security deposit is concerned, the old lessor (transferror) cannot be absolved of his liability towards you, unless you elect to treat the transferee (new owner) as the person liable to you or if the transferree himself agrees to bear with the liability.

So, start correspondence first with the old and new owners to ascertain the status of transfer of property before sending any legal notice to any party.
