respected seniors, myself law student. i am living in a lig flat first floor.my neghbour living in ground floor make ilegal construction and illegal demolition of walls of residention flat to make it godown or showroom means illegal commercial use of this property forcefully.i donot have money to pay fees to lawyer because i belong to poor family.
so i want to file my case myself as litigant.please help me to guide about procedure of it.please also tell me if there is any other mode of stop that construction. that neighbour is a illetrate person and his one son in jail for criminal act.this construction is very dangerous for my property.he always talk with threat .he says have link with police.

File a suit for permanant injunction for restraining him from doing so.

I agree with Archana. U said u r poor then go to the legal aid office, it will be in the court premises. Legal aid officers will refer the case to the standing council and fess will be paid by the govt.,

In addition to the aobve suggestions, it is better to inform the same to Local body/ Municipality about the said construction and request them to stop it .

It is an offence to convert the residential area in a commercial area without obtaining prior detailed approval so the illegal activity can be stopped by informing in writing to the municipal authorities and simultaneously on the ground of personal loos, you can go to civil court and can obtain stay order. Dont believe in his false threatening of links with police. Had he links, how his only son would have gone to jail????

You can contact with Free Legal aid chairman or Secretary. Chief Judicial magistrate of your area is secretary and local district judge is its chairman. a simple application supported with your affidavit is required to seek free legal aid. Not only free advocate shall be provided to you but also all the legal expenses shall also be provided to your counsel by legal aid.
