Dear Respectable seniors
need urgent query's ans.
one of my rental lady she filed a 376 ipc complaint against me which is false case i.e everyone know better from SP to constable. i gave this case to lawyer who is DSP's friend, but he moved (bail application)file to high court and telling everyday one reason which is "THERE IS NO SITTING" all police dept knows about the fact and they are ready to done the B report but they are telling get first bail.first it should be bail. my question is :
1) is there no incharge give to other court in high court ( high court is under Division) not in metro city. please advise me because we don't want to waste of time . sir

If you are sure that Police would give B report then you better wait for it.
If the Bail is refused the police may be put under pressure to file Challan.

Do not take that risk by filing bail petition. Better withdraw it before its hearing.

If 376 charged against you, you must get BAIL FIRST.
lEGAL CR PROCEEDING WILL TAKE IT'S OWN TIME.
kNOWING TRUTH BY ALL/ OR pOLICE IS IRRELEVANT. wHAT IS REPORTED IS IMPORTANT.
court do not recognise fact, or everybody's knowledge, It only consider Evidence, Reports.
As u stated she is one of the tenant, Police/ Lawyers knows where is more money, and whom to target!!
BAIL IS MUST FOR U, OTHERWISE U WILL BE IN JAIL, till released on bail.

Yes as advised by experts, please get yourself enlarged on bail first, then think about contesting the case on merits.

very good evening to you
and many thanks for your valuable suggestions
But sir/madam the fact is police are asking money and behind the that the lady two, three ladies are there they are suggesting to the at lady and she mentioned in complaint before 7 years date it means she said in the complaint in 2007 he raped me. but police know better this is false but they are not ready to do the B report, they are telling only get the bail asap. but our lawyer telling everyday different reason and not giving to my back money also.. i am in very big trouble cant understand what to do now .
main thing is everybody knows about that lady she is characterless and this is second time doing the case but don't know first case where she gave. all her village people saying she is not good but they are not ready to come station or her duty place.
