Filing defamation case in land dispute case

(Querist) 27 September 2013 This query is : Resolved
Dear Sir,

There is a disputed land which my father got registered in Jan 2013.But before that the cousin of actual property holder had sold this land to one of my Village member.
Ideally the land should be of My father since it was purchased from actual owner. Now when father went for registration, after two days a molestation and robbery case was filed by a widow from the other family. This all was a trap from my rivals. Also, the court notices were not reaching to us.Suddenly one week back last notice came which was of arrest warrant.Any how dad got bail. So,can we file a Defamation case in this scenario before the judgement from the court.

Defamation case cannot be filed at this stage rather you need to file a civil suit against the opposite party.

Please suggest how to make strong civil suit in this case.Without the judgement of the current one,can I file one to the opposition.

The criminal case, even if false, does not give you cause of action to file a case of defamation.

For a civil case your facts are not enough to advice.

It is not clear if the deed prior to you has come through impersonation or by false claim of title.

It would be better for you to visit a nearby chamber of civil law lawyer to discuss things.
