Civil property case

(Querist) 20 June 2013 This query is : Resolved
Civil property case pending in court. Three brothers filed case against me. One brother living in India and other two living abroad gave POA one to her wife and other to father in law. After one year father in law of brother also gone abroad and case continues in court. My question is that when my brother is abroad and his POA user has also gone abroad and further they have not given POA to anyone can case without there absence continue. Is there any legal notice be given to court or abroad at brothers residence that how he can simply harass me when presently he nor his POA user is available in India. Please advice

Dear Querist
if they are plaintiff and not ready to appear before court on the date fixed then file an application for dismiss their suit based on non-appearance of the plaintiff.

It is beter to you to file petition under sec.151 c.p.c by saying the same to court.

You state that there are three co-plaintiffs
in the case. The POAs must have appointed an advocate too in the case.It is not necessary
that every plaintiff or his POA must appear in the court on every date fixed in a civil case.

You have not stated that what kind of harassment you are facing if new POAs have not been appointed?

I do agree with the advice of Ld. singh.
