Police is making visits to my home asking for name cut of my relative in 498a case

Hello,

Dec 2011: FIR lodged and 498a is filed on me and my family. Me and my parents and brother are on Regular and AB now. In FIR, FIL included the name of my real Massi visited us for few days from Canada. she is back to her place.

Now police will be filing challan and asking for money to cut my massi name. We have filed Quash of FIR in HC. first Data is in march.

Is it appropriate to pay money to police and get my massi name dropped ? Police people are visiting my home and putting pressure for dropping my massi name.

Kindly advise how to handle them.

no lawyer in this forum will advise you to pay bribe to cops . what you do is your internal matter . dont drag lawyers into the mess .

I am misunderstood. I need your help to understand what i can do legally to handle these cops or complain against them as they are trying to harass.

You can get any Govt servant arrested if he demands bribe for showing official favour or in return of not causingundue harm. It appears taht police has grounds to drop her name from challan and want to encash it.

It is is Union Terriroty police of Police of a State which has by notification conferred jurisdiction to CBI to register cases against State Govt employees then CBI will act. Inother cases State Vigilance Bureas which is heard to be well active in some states.

YOU ARE NOT MISUNDERSTOOD YOU HAD ACTUALY MADE A QUERY THAT "Is it appropriate to pay money to police and get my massi name dropped?" You really wanted to know whether you should or should not pay bribe and you cannot expect experts on this forum to advise you to participate in a crime.

Yes, my advise to you is that you should be bold enough to immediately get in touch with the local Anti-corruption Wing/State Vigilance Bureau or the CBI, as the case may be, and arrange a trap to nab those corrupt public servants. Such a course of action would strengthen your subsequent quashing application in the High Court.

Unless citizens take pain to expose such corrupt public servants, our country cannot get rid of this malaise. Therefore, please show courage to get the policemen booked early. Best wisehs.
