1. If he is arrested then u/s 437 crpc from the Magistrate or u/s 439 from the higher court.
2. If not then u/s 438 crpc from sessions or high court.

It's depend on the sections, some sections are bailable & some are non-bailable, in bailable accused has right to bail otherwise bail is the discretion of court.

Generally sections of gambling act are bailable so magistrate provides the bail immediately. Even no application seeking bail is required and oral prayer can be made. engage a lawyer, He shall tel every procedure relevant for your case.
