NOC

Querist : Anonymous (Querist) 11 June 2011 This query is : Resolved 
My father has made a will in favour of me and my brother..My mother is not included in the will as she is fine with my fathers decision and also has mo interest on the said flat..Now do i also need a NOC/relinquishment from my mother for the same also when we are certain that there wont be any dispute between us as all are agreeing the will drafted..

As rightly suggested by my friend, take signature of mother while taking mutation entry in your favour or while taking probate.

It is always better to have NOC and admission signature from an heir being left,if possible.

No need to do any thing if there is no dispute, do any thing only when any authority required that, if any authority demands NOC from your mother then obtain that otherwise no need to do extra efforts.

To avoid future dispute at the time of applying for Probate, get your mother's signature as one of the attesting witnesses of the Will.
