Delay in Judgement

Querist : Anonymous (Querist) 13 November 2010 This query is : Resolved
In 2006 i was booked under IPC 420 & 471 for having 2 PP. After i came out on bail the judge said me to come back when i receive summon from court. I received summon after 4 years, first hearing was in Jan 2010. From then on i visited court around 3 times then one day examination was done then after that i had 4 more hearings. I had a talk with my lawyer he said police is not attending the court that is why i am getting dates. I am fininacially finished as this thing is going on from last 5 years. I am jobless. i use to work overseas and i am getting good offer from my previous company but because of my pp i am not able to do anything.

Please let me know
1. is there any way that i can speed up my case?
2. how long will court wait for police to show up, is there any time limit or any number that they should show up within?

You can press for speedy disposal. If it is not done, approach the High court u/s 482 Cr.P.C. without wasting further time.

You can press for the early hearing and no evidence of other wittnesses.

I agree with Mr.Subramanian.

482 will lie. only writ can be filed for early disposal of the case.
Kirti Kar Tripathi (Expert) 13 November 2010
sorry, i mean 482 will not lie
Koumarish Bhattacharya (Expert) 13 November 2010
Writ is the better option.
Advocate. Arunagiri (Expert) 13 November 2010
482 cr.p.c. is equivalent to 226 of constitution as for as the criminal cases are concerned. So no writ is necessary, 482 is enough.
Arun Kumar Bhagat (Expert) 14 November 2010
Only option is 482 Cr.P.Code or alternatively prayer would be same but under Article 227 of the constitution. AS an experienced criminal law practitioner one thing I can say from my experience that in case of defence, the delay in trial most of the time becomes boon not the bane.
