how to probate unregistered will made in the name of four nephews in delhi include a flat which is given to one nephew

My fathers brother made a will in 1986 and he died in 1991. He had no children. His wife died in Nov 15 without any will. We are 4 brothers and his will has named all 4 nephew. According to his unregistered will his dda flats is given to one of his nephew. His gold to another one. Avis bank balance to 3rdand another land to 4thone. My question is how to probate this will and what is the procedure.

It is not necessary that the will should be registered but it has to be signed by the witnesses to validate the execution of the will. To execute the terms of the will find a local lawyer and get the things distributed and transferred to the respective beneficiary.

If you are able to divide the left assets amicably as per will, there is no need of getting it probated.

Even otherwise it is not mandatory that the will be probated.
