Dear Experts,
My employer is not accepting my resignation whenever i approach him to accept my resignation and to clear my full & final settlement. he always avoid this....however i had also send my resignation through Email & registered post. Even then No reply at all from employer side. I Need my due salary and experience certificate to get new Job. Pls tell me what should i do in this scenario....

Whether any notice period was mentioned in your appointment letter.
If so, complete the same and leave the job, claim your dues.

Dear Sir
My appointment letter doesn't consist the clause of Notice period.
i have already serve Resignation letter but employer is not accepting the same. In this case does the resignation shall be deemed to be accepted?

Why employer is doing so, whether any liability / case is pending relating to you?
If there is no notice period and if you have proofs of submitting resignation, you can treat your self if you have mentioned the date of relieving in your resignation letter.

Submit final communication narrating all representations ( mention dates/name, minutes etc ) and request to supply the acknowledgment and acceptance of resignation, acknowledgment of hand over of charge, correct FnF statement (showing earned wages/leave encashment/bonus/incentives/OT/reimbursements etc ), FnF dues as per correct FnF statement, Form 16 as per correct FnF statement, salary slips of all months, NOC/NDC, service certificate, relieving letter, PF number and a/c slips of all years, ESIC Card etc …………………..
Mention that NO tasks were pending at your end and NO assets were with you (if True) and you have handed over the charge.

Very vague advice of Mr. Dooba!
By the way, will that help Mr. Ravi Gupta to get his resignation accepted and salary released for sure, even if Mr Ravi Submits "final communication narrating all representations ( mention dates/name, minutes etc ), AND ALSO, whether he is competent to handover charge to whomsoever he would like without the order of the competent authority?
Still further, on what basis Mr. Dooba has advised the author, such as "Mention that NO tasks were pending at your end and NO assets were with you (if True) and you have handed over the charge"? A question arises, has Mr. Ravi stated anywhere that he has handed over charge or the assets of the company?
