(Querist) 19 May 2015 This query is : Resolved 
Can my lawyers ask my estranged wife the following questions.

1- About her extramarital affairs. (She had 4 that I know off).
2- Can I ask her about sending very vulgar and malicious email to her ex boyfriend. She has described very dirty things about her ex boyfriend to her fiancé....so she would leave him.
3- She had abortions with one of them.....can I Ask her in the court in her cross questioning.
4- Can I describe very openly about her characters....she has very bad one.

My local lawyers are saying that we can't ask her personal questions as they are bringing up some Supreme Court ruling that you can't ask a female personal question.

My point is she has filed 498a and other pic sections against me and all of them are lies. Don't I get the chance to tell the court that by doing all this she has done all these things to me.

Vague question!

Are you the guru of your lawyer that he takesguidance from you? He should know wht he can ask and what not. If you want to know for yourself, ask this question from your own lawyer.

If you are not satisfied, show all documents to some senior lawyer and take second opinion.

The points mentioned by you are vague. One should be in a position to prove beyond doubt. Furthermore these points are defence in case filed under Sec.498a. If you cannot prove these things beyond doubt, 498a case will be strong against you as you are mentally harassing your wife without any substantial proof. You are emotionally charged. Believe your advocate and go by his advice.

Of course in criminal cases the cross examination questions need not be centered to the case in hand or the allegations mentioned therein alone, if such questions may add strength to your defense to describe her character and nature due to which she has approached the court with false allegations, they can very well be asked. there is no question of personal questions when she has already come to court to avenge her personal scores against you. In my opinion, your lawyer may very well proceed with such personal questions too but since she being a female, he should maintain that the same is within the decency level.
