CAR ACCIDENT

Me and my family was coming from family function from Amritsar(Punjab) by car. In the way of Beyas, there is a one way road and there is always long traffic on that road. Sir when we were coming back we stuck in that traffic. And traffic was very very long. We were stopped in the road and a car hit our car very badly from our back. He tried to run away from that place first but couldn't succeed. I have bought new car two months back only that accident crashes our back light and bumper and also some dents. We ask the person to pay us our loss at the time of accident then at that time he said he will come to my city and pay my charges. For the sake of security I took his RC of his car so that he will not run. At first he gave me his RC but when we move from that place then we stopped our car to drink some water. At that time same Verna crosses us they came back to us. And one person behaved very rudely and treating us he behaved with the ladies with us. I called police on 100 number. The person who hit my car called some high designated person in police force and get his RC. And for me my loss is near around rupees 20000. Policeman settled by pay us three thousand on the spot and five thousand by self cheque by the person who hit my car. When I went to bank to withdrew that amount there was no money in his account. I tried to call that person but he is not picking my phone. Please suggest me what I can do with that self bounce cheque?

It is good. Now you will get additional chance of filing 2 more criminal cases. One for cheque bouncing and another for cheating.
You can file civil suit for money also.

You cannot file criminal case under Sec.138 of NI Act for "Self Cheque" - why have you accepted self cheque knowing fully well about the man? Best thing is claim Insurance. Hope you might have taken steps in this direction. For few thousands if you file a civil case it will take its own time and you are investing time and good money against bad money.

This is another bitter and inevitable incidence in your life, hence ignore it and proceed with next job, try and get the insurance claim and forget the issue if you really have some other important commitments to look into in your routine life or be prepared to get involved in prolonged legal tangles by filing cases against him for the paltry amounts.

Better file claim with the insurance company for the loss. Try to avoid the new cases.
