Regarding 138

(Querist) 01 August 2014 This query is : Resolved 
That the I had presnt the cheque of Dt.16/4/2014 on Dt.12/7/2014 and the bank return the same to me with mentioning that the the cheque is beyond limitation

my query is whether the period of clearing the is not counted ?

cHEQUE IS NO MORE VALID 3 MONTHS. nO CHEQUE BOUNCE CASE LIES.

The cheque could have been paid in 3 months from date of cheque i.e. upto 15.07.2014.

you have presented cheque within period of 3 months . it ti not beyond limitation . ask drawer for fresh cheque now

The bank cannot return the cheque, it is still within validity period. If returned, proceed against the bank through local lawyer.

The counter foil of the pay-in-slip will be an evidence to prove that you have deposited the cheque with the bankers on time i.e. within the expiry of valid time. You may initiate legal action against the bank, if you have time to follow it up properly or look for an aleternative.
