Non deposit of epf by employer

Dear Sir,
my employer has not deposited EPF for 09 months before i left the company due to non-payment of wages for similar period. druing the period of non deposit of EPF, salary was not paid, however, some advances were given (in lieu of salary - no documentary evidence to that. However, i have salary slips (duly signed by VP HR) for the first 04 months out of 09 months no salary given.
I have met Reg Commissioner EPFO, who says that since no salary was dimebursed, no criminal complaint arises.
kindly advise if i can file an FIR for the same. as this can also help me in recovering some salary maybe.

The EPFO has to initiate proceedings for recovery of PF from employer.
Submit a complaint in writingunder acknowledgment and ask the status thru RTI.
