Dear Sir,
I am Rajesh from Mumbai staying at andheri & my wife is from Ahmadabad. Since from October 10th 2011 she has gone to her home after calling her mother from Ahmadabad & after 1 year she put case against me for bharan poshan against act of 125. As we tried lots to bring her back done lot of meetings but now from last 1 & half year she is refusing to come back in Mumbai in front of Judge in family court at Ahmadabad. So can I take divorce now as I had 2 small kids which are with her only & I had not seen them from last 2 & half years at all. As we were not having any quarrel nothing only she doubt on me that I am having affairs with all girls that it.Due to this I had lost my business clients today & don`t have my business so much due to which my income is zero today. Please advice.

file for divorce on grounds of mental cruelty , desertion as your wife does not want to stay with you .

Try for Mutual consent divorce.
If not agreed, file divorce case on ground of cruelty and desertion.
Prey for visiting rights for children.
Let her prove your income, you can prey that you are unemployed having no income.

Yes, first mutual consent divorce should be tried.
Once it is failed you can go for contested divorce on cruelty.
