Registration of a sale deed

On my agreement for sale which is dated 2012, the stamp duty is paid entirely and correctly. However, the same is not registered.

Now we are executing the Sale Deed in 2013 or 2014. This will be done on a Rs. 100/- stamp paper.

1. Now, on which Market value do I calculate the Registration Fees of 1%, of 2012 or the current year.

2. The fact that the Agreement of Sale is not registered -will it create any hurdle in future.

Please advice. Thanks.

You have to pay stamp duty and registration fees as per prevailing market rate. Appoint an advocate.

As i said appoint advocate. If you calculate the penalty for say 18 months it will 36%. So appoint advocate. He will guide you on paying penalty or paying as per prevaling rate.

Sale Agreement document and sale deed are different documents.moreover the sale agreement is not registered.To execute the sale deed you will have to pay the stampduty and Registration fee.Confirm with Registrar Office
