Maternity benefit act

Dear Concern,

I would like to know that if any employer is not giving the maternity benefit to the employees and even it is not mention in The HR Policy of the company.what action against the company can be taken & what will be the penalty for that?

File civil case or go to high court for writ in such matter

No need of mentioning any provision in HR policy which is confirmed by an act, provided the establishment is not specifically exempted under the provisions of the MATERNITY BENEFIT ACT, 1961 (No. 53 of 1961) 1[12 th. December, 1961].
