Dear Sir,

I have placed an order and issued the cheque (which has been cleared and he has used the money)towards the order but he has not supplied the material so we have purchase the material from some other shop.

He had called us after a months and asked whether you want material or cheque so we have wrote him a letter stating that we want our amount back with 18% interest till date and he accepted through his cell and how he is not giving any response. can we file the suit in the consumer forum or we have to file recovery suit.

pls. let me know what i can do.

You have to file recovery suit u/order 7 rule i of CPC.

No consumer complaint can be filled.

A summary suit for recovery is your remedy as rightly advised by experts herein above but order mentioned by Mr.Goyal has fallen into typo error,read it 37 not 7.
