Dear Sir/Madam,
I am married in may'2005 at the time I am working in Dubai with good job.my wife ask me to assist for her higher education (MSC) i said ok and supported her financial. she completed her MSC we both together planned to work in Hyderabad no need to foreign country. then i return form UAE and got a job in Hyderabad but unfortunately she did not get the job we are together living and run the hose happily, we have one child 5 years.
in our family life we have always facing problems due to lack of finance or some other reasons.i lost the job again i found another job.. these kind of issue going on...
I am hard worker where i am working reconised the management and promoted me before the marriage.after the marriage so many jobs i lost these are the conflicts effects our family life due to my drinking habit. several days she said if you stop your drinking otherwise i will leave the house. she left from my home and went her fathers house.i am completely fed up with her attitude and activities.
finally i visit one of the well astrology pundit in our place, he found her parents cheated you due to change of her Janamanakstra at the time of marraige they said my daughter janamnakshtra was "Swathi" but as per her birth time and date it is "Chitra" the charaterstics of wife similar and matching with her.
i am completely depressed and anxiety. i have this not the correct way i am doing then i search and found job in Kuwait with family status Visa and good salary, i am trying to convenience her and her parents but they don't want to send her back to my home always saying your dunking that is the reason we don;t to send my daughter along with you. the Kuwait is country complete Alcohol Ban country in the world that also i explained them but they did not interested finally they ask me to give divorce to their daughter. i don't give divorce to her because i love her very much
three times i went India and trying to convenience to her and her parents but there is no repose from them. due lack of leave i return Kuwait doing job professionally. but my heart and soul always thinking her, now they put a condition do not talk with my son also.
I have supported my uncles family more than IRS: 5 lakhs. at the time they enquired our village people they about my drinking habit they agreed and do the marriage.
Kindly advise on the below:
1. How I can get back my son from them?
2. Is there any chance to get my money back from uncle?
3. i have leave period 30 days only this is enough time to settle through the court?

Your astrological and astronomical problem don't need any legal solution.
Don't get kicked and tossed between the nakshatras and your family life after getting married without consulting your nakshatras. Don't try to beat the bush of nakshatras after the snake of marriage has already passed.
Just adhere to the simple solution of your wife to stop your drinking habit.

Fully agree with the expert Sh. PS Dhingra ji. A most practical solution is suggested by him.
1. How I can get back my son from them?
-Mother also has the right on son, even after divorce there may be possibility that the same be given to mother and you may get only visiting rights.
2. Is there any chance to get my money back from uncle?
- If you have documentary / ample proof that the money was given as loan, you may file a suit for recovery. Ad-volerum court fee has to be paid and the process is time consuming also.
3. i have leave period 30 days only this is enough time to settle through the court?
- Mutual Consent Divorce after filing the same is finalized after six months. Contested cases may take years. Recovery case against your uncle may also take years.
4. Is there any punishment for cheating in marriage
- Take care of the advise of expert Sh. Dhingra JI. That is the most practical solution for you.
You have good family life associated with the future of your son before you, leave drinking habit totally and the position would improve without intervention of the court,even earlier than the time taken by the court.

ans : money from uncle/nephew/brother/sister/cousines etc is never recovered. It is charity.

Ans : Not at all. even 30 years may be less.

Ans : Practically No.
how do you prove her nakshatra. birth certificate doe snot have the time of birth. how do you find the gynic / midwife on whose evidence you will prove her timing
There is no precedence of such cheating. Personally being Jyotishacharya, I in this legal forum will advgise you against this as not all the perosns beleive in astrology.
